Cancellation Policy
How cancellations and refunds work across kicktide

1. Overview
This Cancellation Policy describes how cancellations and refunds work across the kicktide platform. kicktide is a d/b/a of Attribute Systems Inc., a Texas corporation. Different rules apply depending on the product:
- Tracker subscriptions (SaaS billed to pool service businesses);
- Marketplace transactions (peer-to-peer purchases of routes and assets, funded through Escrow.com);
- Service Plans & customer invoices (recurring billing of Subscribers' own customers through kicktide);
- Account closure (full removal of a kicktide account).
This Cancellation Policy is incorporated into and forms part of the Terms of Service.
2. Tracker Subscription Cancellation
How to cancel
A Subscriber administrator may cancel a Tracker subscription at any time from Settings → Billing, or by contacting support@kicktide.com.
When cancellation takes effect
- Monthly plans: cancellation takes effect at the end of the current billing period. You retain access until then; no further charges occur after that.
- Annual plans: cancellation takes effect at the end of the current annual term. Annual fees already paid are non-refundable except where required by law.
- Free trial: you may cancel any time during the trial at no charge. If you do not cancel before the trial ends, your designated payment method will be billed for the plan you selected.
Refunds
Tracker subscription fees are generally non-refundable. Pro-rated refunds may be issued at kicktide's discretion for material service outages, accidental duplicate charges, or where required by law. Refund requests must be made within 30 days of the charge.
Data after cancellation
After cancellation, Subscriber Data remains available for export for 30 days. After that period, we may delete or anonymize the data, except for records we are required to retain for legal, accounting, or fraud-prevention purposes.
3. Marketplace Transaction Cancellation
Before the brokerage fee is charged
Either party may withdraw at any time before the buyer pays the platform brokerage fee. Listings may be removed by the seller at any time before a buyer commits to purchase.
Brokerage fee refunds
The kicktide brokerage fee covers listing facilitation, payment processing, support, and escrow coordination. It is non-refundable once charged, with these exceptions:
- Seller withdrawal or breach. If the seller withdraws after the brokerage fee is charged but before escrow funds are released, or materially breaches the Seller Warranty, the buyer is entitled to a full refund of the brokerage fee.
- Listing misrepresentation. If the Marketplace listing is materially false or misleading and the transaction is canceled during the escrow inspection period as a result, the buyer is entitled to a full refund.
- Platform error. If a transaction cannot be completed due to a Platform error attributable to kicktide, we will refund the brokerage fee.
Escrowed purchase funds
Purchase amounts are held by Escrow.com under their separate terms of service. Escrow release, return, and dispute procedures are governed by Escrow.com — including any inspection period, dispute window, and arbitration. Escrow.com fees follow their published fee schedule.
Disputes
Buyer/seller disputes should first be opened through the Platform's dispute tooling so we have a complete record. kicktide may, but is not obligated to, assist in resolving disputes. We may pause escrow release or freeze a listing while a dispute is open.
4. Service Plans & Customer Invoices
Where a Subscriber bills its own customers through kicktide — including recurring "Service Plans", one-off work-order invoices, and auto-charge arrangements — the contract for service is between the Subscriber and the customer. The Subscriber sets and is responsible for the cancellation and refund terms of those services.
Customers should:
- Contact their pool service provider (the Subscriber) directly to cancel ongoing service, change a Service Plan, or request a refund;
- Use the in-Platform payment-method controls to revoke auto-charge consent at any time. Revoking consent stops future auto-charges; it does not by itself terminate the underlying service agreement or cancel amounts already owed.
kicktide will reverse a charge initiated through the Platform where the Subscriber instructs us to do so, where required by Stripe or card-network rules, or where required by law.
5. Chargebacks
If you dispute a charge with your card issuer, we may share transaction records with the issuer to respond to the dispute. We encourage you to contact us first — most issues are resolved faster directly. Excessive or unfounded chargebacks may result in account suspension.
6. Account Closure
You may close your kicktide account at any time by emailing support@kicktide.com. Closure cancels any active Tracker subscription at the end of the current billing period and revokes Platform access. Certain records — financial transactions, audit logs, debt-collection records, and similar — are retained under applicable retention rules even after closure, as described in the Privacy Policy.
7. kicktide-Initiated Cancellation
We may cancel or suspend any subscription, listing, or transaction for violation of the Terms of Service, suspected fraud, abuse, or legal risk, with or without notice. Where we cancel a paid subscription without cause, we will refund any unused pre-paid fees on a pro-rated basis.
8. Changes to This Policy
We may update this Cancellation Policy from time to time. Material changes will be communicated by email or in-Platform notice. The version posted here on the date of cancellation applies to that cancellation.
