How kicktide collects, uses, and protects your information

1. Overview
This Privacy Policy explains how kicktide — a d/b/a of Attribute Systems Inc., a Texas corporation ("kicktide," "we," "our," or "us") — collects, uses, and shares personal information in connection with the kicktide platform, including the kicktide.com website, the kicktide web application, and the kicktide mobile application (collectively, the "Platform"). The Platform includes the Marketplace (peer-to-peer transactions), Tracker (field service management software for pool service businesses), and a companion mobile application for field technicians.
Attribute Systems Inc. is the data controller for personal information processed in connection with the Platform, except where a Subscriber is the controller of its own customers' information (described below).
If you are a customer of a pool service business that uses Tracker, that business is the "controller" of your personal information and is responsible for its own privacy practices. kicktide processes that information on the business's behalf.
2. Information We Collect
Information You Provide
- Account information: name, email, phone number, mailing address, password, role, and (where applicable) employer.
- Subscriber/business profile: business name, service area, branding, technician roster, and operational configuration.
- Customer records: names, addresses, contact details, equipment, water-body details, and service history entered by Subscribers about their customers.
- Marketplace content: listing details, descriptions, photos, financials, and supporting documents.
- Payment information: handled by Stripe and/or Escrow.com; we receive limited tokens and metadata (e.g., last-four, brand, billing ZIP) — not full card numbers.
- Communications: messages you send through the Platform, support tickets, and survey responses.
Information Collected Automatically
- IP address, browser, device identifiers, and OS;
- Pages visited, features used, and timestamps;
- Referring URLs and search terms;
- Approximate location from IP, and precise GPS location from the mobile app when a technician is on the clock (only with permission);
- Cookies, local storage, and similar technologies.
Information From Third Parties
- Identity and authentication data from Google OAuth when you sign in with Google;
- Payment and risk signals from Stripe and Escrow.com;
- Business and property data from public records and data enrichment partners (used primarily for B2B prospecting and market analytics).
3. How We Use Information
We use personal information to:
- Operate, maintain, and improve the Platform;
- Authenticate users, route work, and enforce role-based access;
- Process Marketplace transactions, brokerage fees, and escrow flows;
- Process Tracker subscription billing and invoicing of Subscribers' customers;
- Send transactional messages (receipts, reminders, notifications) by email, SMS, and push;
- Provide customer support and respond to inquiries;
- Detect, investigate, and prevent fraud, abuse, and security incidents;
- Generate aggregated, de-identified analytics and industry benchmarks;
- Comply with legal obligations and enforce our agreements;
- Send marketing communications, where permitted (you can opt out at any time).
4. How We Share Information
With Other Users
Marketplace listings are publicly visible by design. When you engage in a transaction, certain contact information is shared with the counterparty. Tracker data flows between roles within the same Subscriber (administrators, technicians, customers) as configured by the Subscriber.
With Service Providers
We share information with vendors that operate the Platform on our behalf:
- Stripe — payments and Connect (subscriber billing);
- Escrow.com — Marketplace escrow services;
- Neon — managed PostgreSQL hosting;
- SendGrid — transactional and marketing email;
- Twilio — SMS and voice;
- UploadThing — file storage;
- Mapbox — mapping and geocoding;
- Google — OAuth authentication;
- Analytics and error-monitoring providers.
For Legal Reasons
We may disclose information when required by law, subpoena, or court order; to protect our rights, property, or safety, or that of our users or the public; to enforce our Terms; or to investigate potential violations.
Business Transfers
In a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred subject to standard confidentiality protections.
We Do Not Sell
We do not sell personal information for monetary consideration. We may share aggregated, de-identified data that cannot reasonably be linked to you.
5. Cookies & Tracking
We use cookies, local storage, and similar technologies to keep you signed in, remember your preferences, secure the Platform, measure usage, and improve our services. You can manage cookies through your browser settings; disabling cookies may affect Platform functionality. We currently do not respond to browser-level "Do Not Track" signals.
6. Data Security
We implement reasonable technical and organizational measures designed to protect personal information, including encryption in transit, hashed password storage, access controls, audit logging, and PCI-compliant payment processing through Stripe. No system is perfectly secure; we cannot guarantee absolute security.
7. Data Retention
We retain personal information for as long as your account is active or as needed to provide the Platform, comply with legal obligations (including tax, accounting, and consumer-finance rules), resolve disputes, and enforce our agreements. Certain records — for example, transaction history and debt-collection records — are retained under longer statutory schedules even after account closure.
8. Your Rights & Choices
Depending on where you live, you may have the right to:
- Access or receive a copy of your personal information;
- Correct inaccurate information;
- Delete your information, subject to legal exceptions;
- Restrict or object to certain processing;
- Withdraw consent where processing is based on consent;
- Lodge a complaint with a data-protection authority.
You can update most account information directly in your settings. For other requests, email privacy@kicktide.com. If you are a Subscriber's customer, please contact that Subscriber first; we will assist them in fulfilling your request.
You may opt out of marketing email through the unsubscribe link in any marketing message. Transactional and security messages are not optional while your account is active.
9. SMS Communications (A2P 10DLC)
If you provide a mobile number, you may receive SMS messages related to your account, appointments, invoices, and (where you consent) marketing. Standard message and data rates may apply. Reply STOP to opt out or HELP for help. Opt-out applies to the message category you receive it on.
10. Children
The Platform is intended for users 18 and older. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, please contact us and we will delete it.
11. International Transfers
The Platform is operated from the United States. If you access it from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data protection laws than your country.
12. California Privacy Rights (CCPA/CPRA)
California residents have additional rights, including the right to:
- Know the categories and specific pieces of personal information we collect, use, disclose, and sell or share;
- Delete personal information, subject to exceptions;
- Correct inaccurate personal information;
- Opt out of the sale or sharing of personal information;
- Limit the use of sensitive personal information;
- Be free from retaliation for exercising your rights.

13. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by email or in-Platform notice. Continued use of the Platform after a change constitutes acceptance of the updated policy.
